Administrative Court cannot rule on our opinion in the Jolevski – Ristoska case, says Anti-Discrimination Commission

The Commission for Prevention and Protection against Discrimination filed an appeal following the ruling of the Administrative Court regarding the opinion of the Commission, which established discrimination by the Public Prosecutors Council against prosecutor Lenche Ristoska.

The Administrative Court cannot decide on the opinions of the commission, because they are not administrative acts, said the commission and demanded that the Higher Administrative Court cancel the disputed judgment and return it to the previous decision of the Administrative Court, with a direction to pass a decision on dismissing the lawsuit as inadmissible.

The commission considers that essential violations of the provisions on the procedure and wrong application of substantive law by the Administrative Court have been committed.
