Nationality column in birth certificates are unconstitutional, rules Constitutional Court – Lloga did not respect the constitutional deadline of 7 days

The 10-day delay in publication undermined the Guidelines for Nationality Statements. The Constitutional Court considers that it is a fundamental violation of the Constitution that the Minister of Justice Krenar Lloga submitted the signed instructions to the archive on May 29, and it was published only after 17 days, instead of within a week. Because of that, the instruction that allowed entering the nationality column in birth certificates was canceled.

On July 5, on its own initiative, the Court initiated a procedure and issued a temporary measure to stop such extracts. Those citizens who took out a birth certificate during that short period of 20 days while the Guidelines were in effect, will have to request the annulment of the document themselves.
