A public office must not and cannot be a shield from criminal liability. LDP demands the immediate dismissal of government official Dalibor Kitanovikj, and that the Ministry of Interior (MoI) and the Public Prosecutor’s Office (PPO) immediately act ex officio in accordance with Article 407-a of the Criminal Code, because the laws in this country must finally apply to everyone equally, Liberal Democratic Party (LDP) said in a press release Sunday.
The Liberal Democratic Party announced that it strongly condemns the scandalous and hypocritical reaction of the Government, which instead of immediately dismissing and criminally prosecuting director Dalibor Kitanovikj for glorifying a convicted war criminal, miserably offered him the opportunity to “withdraw his position.”
The LDP says that for glorifying, approving and minimizing genocide and war crimes, Article 407-a of the Criminal Code clearly stipulates a prison sentence of up to five years. According to the party, the legal provision is decisive and there is simply no option in the Criminal Code to resign from one’s position after the crime has already been committed.
The party demanded that Kitanovikj be dismissed and prosecuted.
Two days ago, the director of the Agency for the Realization of the Rights of Communities, Dalibor Kitanovikj, posted a photo montage on Instagram, showing Ratko Mladić together with figures from Serbian history, including Draža Mihajlović, and in large letters it is written: “Generals of the Heavenly Army”. This caused strong reactions in the public, and the civil society sector called for Kitanovikj to be held criminally responsible.
The government called on the director to resign from his position if he does not agree with the position that Ratko Mladić has been convicted of genocide and war crimes.
Following this, the Democratic Party of Serbs in Macedonia expressed support for Kitanovikj in a Facebook post, sharing comments on social media expressing support for him.
