Constitutional Court to review the rule in the Law on Budgets for 30 percent wage supplements for some administration employees

At Monday’s session, the Constitutional Court initiated a procedure for evaluating the constitutionality of Article 66, paragraph 3 and paragraph 4 of the Law on Budgets. This means that at this stage the Court expresses doubts about the constitutionality of the current special rule by which 30% is paid as a supplement to the basic salary of employees in the Ministry of Finance, in the Public Revenue Office, Customs Administration, State Foreign Exchange Inspectorate, Bureau of Public Procurement, Authority for Prevention of Money Laundering and Financing of Terrorism, Financial Police Authority, listed in the Authentic Interpretation of the Parliament.

According to the Court, provision of payment in the manner as stipulated in the contested paragraph, without first establishing such a right in law for employees, is contrary to the rule of law as a fundamental value and contrary to Article 32 paragraph 5 of the Constitution, according to which the realization of the rights of the employees are governed by the Law and the collective agreement.
