We did not have a law before, although fair representation was and is a constitutional norm in the Republic of Macedonia. However, it was not legally regulated, but there was a tool called the balancer, which the Constitutional Court abolished, and it was used exclusively as a party booty of DUI, using the balancer to employ party soldiers of DUI and absolutely nothing was done in terms of the purpose for which that tool was brought, VMRO-DPMNE MP Brane Petrushevski said in an interview.
The MP says that the new Law on Fair Representation will be adopted through a public and transparent procedure. According to him, the so-called balancer tool is an outdated tool that did not produce the expected results, which was concluded by the Constitutional Court, international institutions and DUI in 2023. He added that the balancer tool was used primarily for party employment.
“We have come to a situation recently in the country where we will bring a modern, European solution in terms of proper representation. We received approval and a positive report from the Venice Commission, which is an institution with top experts in constitutional law, which gives strong legitimacy to this Law,” said Petrushevski.
The ruling party representative stresses that what will be different from the current practice is the introduction of the merit system, i.e. the principle of meritocracy. According to him, instead of hiring along party lines and by referring to the balancer tool, priority will be given to the expertise, competence and merits of the candidates.
