Kamchev cannot claim EUR 1.5 million in damages for “Racket” case, rules Supreme Court

The Supreme Court ruled that businessman Jordan Kamchev does not have the right to claim compensation of EUR 1.5 million in a civil proceeding related to the “Racket” case, assessing that he cannot be considered an injured party in the case.

Kamchev filed a lawsuit in 2022 against Katica Janeva, Bojan Jovanovski and Zoran Milevski – Kicheec, as well as against the former Special Public Prosecutor’s Office (SPO), demanding the joint return of the funds he claims were given as “racketeering”, but later withdrew from some of the claims.

The Supreme Court states that the plaintiff participated in “morally impermissible collusion” with the defendants, in order to facilitate his legal position in the “Empire” case, which is why he is not entitled to a refund of the funds. It is also assessed that the payment of funds constitutes a criminal offense of “giving a reward for unlawful influence”, and any compensation would violate the integrity of the justice system.
