Macedonian President GordanaSiljanovska-Davkova believes that the Ombudsman protects the rights of citizens when they are violated by the state and public administration, and that the Ombudsman has no jurisdiction over the work of ministers. We need, the head of state says, to learn that there are two interpretations of the Constitution and laws, judicial and scientific, and that they should not be interpreted through their party, which, as she pointed out, unfortunately often happens in the country.
“I do not dare to comment on other institutions, but I know a lot about the Ombudsman within the framework of my profession, of course. Ombudsmen are tribunes of citizens, who protect their rights when they are violated by the state and public administration. They have no jurisdiction over ministers, I must emphasize, and of course, when they act, they should adhere to the Constitution and the law,” Siljanovska-Davkova said, asked about the Ombudsman launching an investigation for obstructing the taking of the bar exam in Albanian language.
The President points out that there are two types of interpretation of the Constitution and laws.
“One is the judicial interpretation, and the other is the scientific one. Unfortunately, in our country, the party interpretation of laws dominates. Sometimes in that interpretation, it even acts as a quasi-constitutional court. So, the assessment of the constitutionality of laws and other general acts is given by the Constitutional Court, and not through our interpretations,” said the Macedonian President in response to media questions after the end of the event dedicated to the Macedonian language.
The Ombudsman has launched a case on his own initiative for obstructing the taking of the bar exam in the Albanian language. Minister of Justice Igor Filkov previously stated regarding the taking of the bar exam in the Albanian language that the exam, according to current legal solutions, can only be taken in Macedonian, and he assessed all other requests as pressure.
