Thirteen-year-old will not be held criminally liable for stabbing peer, Court orders 30-day detention to 19-year-old brother

The 13-year-old brother of the detainee will not be held criminally liable, despite the fact that, according to the police statement, it was he who stabbed the three people, including the 13-year-old child who is in a life-threatening condition because he stabbed him in the heart.

The Skopje Criminal Court ordered a 30-day detention for the 19-year-old who participated in the bloody fight in Skopje’s Chair on Monday, in which he and his 13-year-old brother inflicted stab wounds on three people, two of whom were minors. The Court informs that the detention was ordered on all 3 legal grounds: flight risk, collusion danger and recidivism risk.

“A judge in a preliminary procedure at the Skopje Basic Criminal Court, acting upon a proposal from the Basic Public Prosecutor’s Office Skopje to determine a measure to ensure the presence of 19-year-old B.I. from Skopje, suspected of violence against a child in Skopje’s Chair, after his statement regarding the proposal, issued a decision ordering him to be detained for 30 days. B.I. is suspected of violence under Article 386, paragraph 6, in conjunction with paragraph 3 of the Criminal Code,” the Court informed Wednesday.

The 13-year-old brother of the detainee will not be held criminally liable, despite the fact that, according to the police statement, it was he who stabbed the three people, including the 13-year-old child who is in a life-threatening condition because he stabbed him in the heart.

The Public Prosecutor’s Office (PPO) said Tuesday that the 13-year-old was not subject to criminal liability.

“The 19-year-old suspect and his underage brother, who is below the legal limit for criminal responsibility, committed acts of violence that caused serious bodily injuries to one child and one adult with stab wounds, and another child was slightly injured. They caused a feeling of insecurity, threat, fear and anxiety among the public and those present. The public prosecutor submitted a proposal to the pre-trial judge to determine a measure of detention for the suspect adult,” the statement from the Prosecutor’s Office said in a press release.
