During its 85th session, the Macedonian Parliament adopted a law amending the Law on Treatment of Illegally Constructed Buildings,, extending the deadline for another five years, i.e. until 2031. The additional five years are given to complete the procedures for facilities built until 2011 and formally the amendments do not open a new door for new requests, but refer exclusively to those citizens who have already submitted documentation and have been waiting for a resolution for years.
The law was adopted with 67 votes in favor, five against and no abstentions.
At the beginning of the month, the ZELS Board of Directors submitted a request to the Parliament, the Government and the Ministry of Transport in order to allow an extension of the deadline for the Law on Treatment of Illegally Constructed Buildings until 2031.
The request itself from the ZELS Board of Directors explains that a large part of the procedures were not completed due to litigation related to the rights to the constructed facilities, court proceedings initiated within the framework of the procedure conducted before the municipality, postponement of the adoption of administrative acts in the procedure due to hereditary and other property-legal circumstances, which should have been resolved as a previous issue in the procedure, as well as other unforeseen circumstances, whereby the extension of the deadline is intended only to complete the procedures that have already been started, and not to submit new requests and form new cases for action.
Initially, such a law was adopted in 2011, and with the amendments adopted today in Article 5, the words “fifteen years” are replaced with the words “twenty years”, which indicates the duration of the legalization process.
